General Terms and Conditions of Travel

The following provisions become part of the package travel contract between the traveller and Spiritup.Tours, provided they are validly agreed.

1. Conclusion of the Travel Contract

  • The basis of the offer is the travel description and supplementary information of Spiritup.Tours valid at the time of booking.
  • The traveller is liable for all contractual obligations of persons registered by him/her, if expressly declared.
  • If the confirmation differs from the booking, it constitutes a new offer valid for 11 days.
  • No right of withdrawal applies for package travel contracts concluded at a distance (§312g BGB); only cancellation rights apply (§651h BGB).

2. Payment

  • Deposit: €500 upon contract conclusion (after receiving the security certificate).
  • Balance due 60 days before departure (latest receipt: 30 days before departure).
  • In case of non-payment, Spiritup.Tours may cancel and charge cancellation fees.

3. Contract Changes Before Departure

Minor changes are permitted if reasonable. Significant changes allow the traveller to accept, cancel free of charge, or request an alternative trip.

4. Price Changes

Possible in case of increased transport costs, taxes, or exchange rates. Increases above 8% entitle the traveller to withdraw without charge.

5. Cancellation by the Traveller

  • Up to 56 days before departure: 20%
  • Up to 28 days before departure: 50%
  • Up to 14 days before departure: 75%
  • Later or no-show: 100%

Refunds will be made within 14 days. Travel cancellation insurance is recommended.

6. Rebooking

Possible within 30 days after booking confirmation for €50 p.p., provided departure is more than 4 months away. Special conditions may apply for flights, hotels or private tours.

7. Non-Used Services

No refund for unused services unless statutory cancellation rights apply.

8. Minimum Number of Participants

If not reached, Spiritup.Tours may cancel 28 days before departure and refund payments.

9. Termination for Behaviour

If a traveller seriously disturbs the trip despite warning, Spiritup.Tours may terminate without refund.

10. Traveller Obligations

  • Check travel documents.
  • Report defects immediately to local representatives.
  • Report baggage damage/delay to airline (P.I.R.) within deadlines.

11. Liability

Liability for damages (excluding bodily injury) limited to 3x travel price. Spiritup.Tours is not liable for third-party services (e.g. excursions, transport) if clearly marked as such.

12. Assertion of Claims / Dispute Resolution

Claims must be submitted to Spiritup.Tours. Spiritup.Tours does not participate in voluntary consumer dispute resolution. EU ODR platform: ec.europa.eu/consumers/odr.

13. Airline Information

Spiritup.Tours must inform the traveller about the operating airline. Blacklist: EU Air Safety List.

14. Passport, Visa, Health

The traveller is responsible for travel documents, visas, vaccinations. Spiritup.Tours informs about general requirements before booking.

15. Legal Venue

German law applies. Place of jurisdiction: registered office of Spiritup.Tours.
